When you go to a shooting range, you're participating in an activity that involves inherent risks.
Even with all the safety precautions in place, accidents can still happen.
An indemnity form is essentially an agreement between you and the shooting range.
What it does:
It acknowledges that you understand the potential dangers involved in the terrain and in using firearms.
It states that you won't hold the shooting club, the range or its staff (instructors, range officers, etc.) responsible for any injuries or damages you might experience, unless they were directly caused by their gross negligence.
In simpler terms, you're saying, 'I know this is risky, and I'm taking responsibility for myself.'
Why it's necessary (and how it benefits everyone):
For the shooting range: It protects them from being sued for accidents that are a normal part of the sport, allowing them to focus on providing a safe environment. It also protects the instructors and range officers.
For the participant: It forces a clear understanding of the inherent risks, promoting personal responsibility and caution. Without these agreements, many ranges could not operate, and therefore the participant would not be able to partake in the activity.
For both parties: It creates clear legal boundaries, clarifies responsibilities, and incentivizes safe practices. This mutual understanding helps prevent disputes and promotes a safer environment for everyone.
Think of it like this:
Just like signing a waiver before going skydiving or rock climbing, you're agreeing to accept the risks associated with shooting.
It is a way to ensure that all parties are aware of the risks involved.
Essentially, by signing the indemnity, you're confirming that you understand the risks and agree to participate at your own risk. While it primarily protects the club, organizers and shooting range, it also establishes a framework that benefits both parties by clarifying risk, enabling the activity, and promoting safety."

Waiver and Indemnity Agreement For Target Shooting Range
I acknowledge that I take part in target shooting exercises on this shooting range, entirely at my own risk. I hereby agree that I and my dependents waive and shall not have, nor institute any claims whatsoever against, and do hereby indemnify and hold harmless from all liability, the owner of this shooting range area, Ellingham Quarry, the Executive Oversight Group of Umzinto Shooting Club.
This waiver includes: death, injury, damage to, and loss of property to myself and is effective whether or not such death, injury, damage, or loss may have been caused directly or indirectly, or wholly or partly by any act or omission including negligence, of Ellingham Estate, the owner of this shooting range area or the Executive Oversight Group of Umzinto Shooting Club. It will bind the heirs, executors, and trustees of the estate of the person signing this indemnity.
Without derogating from the generality of the foregoing, I specifically record that I am aware of the dangers and injury which shooting firearms, as well as animals, reptiles, birds, insects, plants, terrain, and other natural hazards, pose. This indemnity and waiver will include any claim whatsoever arising in respect of any injury or damage caused by any shooting-related accident, animal, insect, bird, reptile, plant, terrain, or similar event on this shooting range.
As the person signing this indemnity and as the parent and/or guardian of a minor, I hereby agree to such minor being bound by the afore-going waiver and indemnity. I further indemnify the owner of this shooting range, the shooting club, and the club’s officials against claims by such minor to the extent, if any, to which such minor is not capable of waiving his/her rights as stipulated above.
The owner of this shooting range, Ellingham Quarry, and organizers of the specific shoot, Umzinto Shooting Club at all times reserves the right of access to this shooting range.
By signing the range register, I acknowledge that I at the same time also sign this indemnity.
Safety and Conduct Commitment:
I understand that I use this shooting range at my own risk and undertake at all times to apply the universal gun safety rules. I shall wear eye and ear protection, and keep my firearms bagged until I use them at the shooting point. I understand the inherent risks and shall ensure that any guest or family member that accompanies me will also adhere to the range rules and wear eye and ear protection.
I will ensure that the action of my firearm is open and/or safe and that no round will be in the chamber of my firearm before I, or anyone else, moves forward to targets.
